Wednesday, February 28, 2024 –Attorney General Justin Muturi has declared the Housing Levy unconstitutional.
Muturi who has been playing hot and cold on the contentious matter, today released his final statement which he had also signed stating that the levy is not founded in law. He cited the two rulings by the High Court as well as the Court of Appeal both which declared the levy illegal.
In the statement shared to our desk on Wednesday February 28, the AG said the government will be breaking the law should it go ahead and force employers to remit the levy.
“It is noted that the Housing levy was introduced by Section 84 of the Finance Act, 2023. However, upon determination by the High Court in Constitutional and Human Rights petition, the imposition of the housing levy was declared unconstitutional,” he confirmed through his fully signed statement.
Muturi’s remarks now dealing a big blow to his boss President William Ruto who has, not once, insisted that the housing project will continue no matter what happens.
Ruto and his deputy Rigathi Gachagu have been accusing the Judiciary of deliberately frustrating their efforts to implement some of their key projects.
The Kenya Kwanza leadership argues that the housing project was meant to employ millions of jobless youths across the country and that any contrary to this will deny the poor some of their basic rights.
