Wednesday, February 7, 2024 –Kakamega County Senator Boni Khalwale has moved to the High Court of Kenya to sue Kakamega-based businessman Cleophas Shimanyula Toto.
Speaking today over the matter just two days after laying to rest his caretaker, Kizito Moi Tamala Amukune, who was gored to death by his bull in Ikolomani, the politician flanked by his Lawyer, Danstan Omari, said he now want an explanation from Toto within the next 48 hours.
Among the things he has sought include cash compensation of sh 200 million together with an apology for face a gruesome legal suit that could see him forced to pay the senator a whopping sh 500 million
“Today at the High Court of Kenya, we have given Cleophas Shimanyula Toto 48 hours, within which he should tender an apology for defamatory allegations against me and pay a compensation of sh 200 million. Failing which he will face a suit of Ksh. 500 million in the High Court,” he released the statement.
Mr. Shimanyula, a prominent businessman and a contractor in Western part of the country, days ago, accused the senator of stabbing to death Kizito Amukune and blaming it on the bull.
Toto was captured on camera claiming that the late had been cohabiting with Khalwale’s wife in the village hence the animosity that saw the enraged senator finally attack the worker at night on a Friday.
“We have sufficient information that Khalwale attacked and murdered the innocent man at night after learning that the man was cheating with one of his wives at home.
“There is no way a bull can attack anyone at night when there is laud silence and nobody hears the commotion or screams,” he stated.
The businessman would add that he is ready to fund for thorough investigations so that the poor family of the diseased could get their deserved justice.
This is even after a section of the late differed with him saying they had no problem with Khalwale on the matter.
And when investigations commenced including medical examination, Government Chief Pathologist Johanesen Oduor settled the matter saying he had established that the bull actually killed the 47-year-old farm worker.
Claims by Toto and some residents had also clashed with the post-mortem report by Western Region pathologist, Dr Dickson Muchana, which showed the victim had died from animal injuries.
The late has since been laid to rest at his home in Malinya Ikolomani Kakamega County.
